Terms of Service

Draft. This is a working version of our terms. It will be reviewed by counsel before launch and may change.

Overview

These terms are the agreement between you and Foundra Studio when you use Podscape. They cover what you can expect from us and what we expect from you.

1. Acceptance of terms

By downloading, installing, or using Podscape you agree to these terms. If you don't agree, please don't use the app.

2. Your account

You must be at least 13 years old to use Podscape. One account per person. You agree to give us accurate sign-up information.

You're responsible for keeping your sign-in credentials secure and for activity that happens under your account. Tell us right away if you suspect unauthorized access.

3. Acceptable use

Don't use Podscape to break the law or to abuse, harass, or threaten other people. Don't scrape the service at scale, don't use automated access without our written permission, and don't try to reverse engineer the app except where the law specifically allows it.

Don't use Podscape to redistribute podcast content or AI-generated transcripts outside the app.

4. Podcast content

Podscape plays podcasts from public RSS feeds. We don't own those podcasts and we don't modify the original audio. Copyright in podcast content belongs to the people who made it.

If you believe content available through Podscape infringes your copyright, send a takedown request to support@foundrastudio.com with enough detail for us to identify the work and the alleged infringement.

5. Auto-generated transcripts and insights

Transcripts, chapter markers, summaries, and other insights generated by Podscape come from automated systems and may contain errors. They're licensed for your personal use inside the app — they're not licensed for redistribution.

We may revise or remove auto-generated content at any time.

6. Your content

Notes, saved moments, and other content you create in Podscape belong to you. You give us a limited license to host and display them so the app can work — that's it. You can export or delete your content from the app at any time.

7. Push notifications

If you enable push notifications you consent to receive them according to your in-app preferences. You can change those preferences in Profile → Notification preferences or turn notifications off in your device settings.

8. Pricing

Podscape is currently free to download and use. If we introduce paid features in the future we'll make the terms clear before you pay.

9. Termination

You can delete your account at any time from inside the app or by emailing support@foundrastudio.com. We may suspend or terminate accounts that violate these terms.

10. Disclaimers

Podscape is provided "as is" and "as available." Auto-generated transcripts and insights may contain errors. We don't guarantee uninterrupted or error-free service, and we may modify or discontinue features.

11. Limitation of liability

To the extent allowed by law, Foundra Studio is not liable for indirect, incidental, or consequential damages arising from your use of Podscape. Our total liability for anything related to the app will not exceed the amount you have paid us in the last twelve months (which is currently zero for free accounts).

12. Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute that can't be resolved by email goes to the state and federal courts located in Delaware.

13. Changes

We may update these terms. If we make a material change we'll notify you inside the app and bump the "Last updated" date.
